Power of Attorney

A "Power of Attorney" is a document wherein you appoint a person to act as your agent. It is mainly used to help in the event of your illness or disability, or in a situation where you can't be present to sign necessary legal documents. Making the power of attorney durable means that the agent's power does not terminate even after you become incapacitated.

A Durable Power of Attorney (DPOA) is a highly recommended document that greatly assists your family and friends should you become ill or incapacitated. It allows the person you appoint to handle all of your affairs, including signing checks, paying bills, making deposits, managing your assets, and many other functions. If you do not have a DPOA, another person does not have the right to sign legal documents for you, even if it is your spouse. Once you become incapacitated, it is too late to draft a DPOA - - it must be drafted and signed in advance of any incapacity.
