Property acquired after the marriage is generally referred to as marital property, and is the property that the court divides in a divorce. Nonmarital property is property acquired prior to the marriage or by gift or inheritance after the marriage. While these are general rules, there are many complicated exceptions. If you are concerned about your property rights during a divorce, an experienced family law and divorce attorney can help.
Child support, child custody, and visitation arrangements are also determined largely on information presented to the court by your attorney on the best interest of the child, including information provided on:
- The interaction and relationship of the child with parents, siblings and any other persons affecting the child
- The needs of the child to have a continuing relationship with both parents and the ability and willingness of each parent to perform their functions as mother and father of the child
- The mental and physical health of all parties
- The child's adjustment to his or her home and school.
- The parties' incomes, or the income they are capable of making
- The financial needs of the child
- Court calculation forms (Form 14)
Attorney Christopher Cox is skilled in all aspects of divorce and family law, at negotiating with opposing counsel and at advocating for your rights in court hearings and in trials.
